States ask court to block EPA enforcement policy

A coalition of nine states on Monday asked a federal judge to block EPA’s March guidance on enforcement nationwide during the coronavirus pandemic, arguing that each day it remains in place, “the increased pollution it incentivizes will irreparably harm the States.” EPA has always maintained that the policy will not lead to any real-world increases of pollution, but the states argue it is “an abdication of EPA’s statutory duty to protect public health and the environment.” The states, led by New York and California, argued that they have stuck to case-by-case consideration of virus-related compliance issues and said EPA should have taken the same targeted approach rather than a blanket waiver.
