Competitive Enterprise Institute floors it on safe vehicle challenge

The publication of the SAFE Vehicles rule in today’s Federal Registermeans it’s open season in court for the auto emissions rollback. California and its allied states, as well as environmental and public health groups, are expected to file legal challenges over the next 60 days. But the first suit out of the gate may be from the conservative Competitive Enterprise Institute, which shared with ME its plans to file a suit this morning. “The agency was right to roll back the scheduled increases in fuel economy standards, which would have made cars less crashworthy and increased highway fatalities,” said CEI general counsel Sam Kazman. “But NHTSA should have reduced those standards even more, and perhaps frozen them entirely.” CEI is similarly challenging EPA’s Affordable Clean Energy rule as too stringent.
